In order to pursue a redundancy claim our solicitors at Hattin Solicitors will need to check the merits of your case.

We will need to check the employee is eligible to bring the redundancy claim. The employee must have been at least two years in continuous service and there must also be a dismissal by reason of redundancy.

Redundancy occurs in three different scenarios: job redundancy ( where the business closes down); place of work redundancy (the job at the current location no longer exists) and employee redundancy (there is a reduction in the requirement of employees to do work of a particular kind).

If an employee is found to be eligible and the reason for the dismissal was redundancy, they are entitled to a statutory redundancy payment from their employer.

If any employee is offered a suitable alternative job by their employer which is refused unreasonably, they may lost their entitlement to a redundancy payment.

A redundancy payment is calculated by applying a formula based on age, length of service and weekly pay.

The situation of an employee who is dismissed by reason of redundancy may also give rise to a wrongful or unfair dismissal claim.
